Summary/Abstract: This paper, presented in terms of jurisprudence, is a warning to „actors” of the health system and focuses on accountability of local governments with direct responsibilities on effective management of human and financial resources of public health units, with an eye to the respect of patients' rights, in fact the rights of its own citizens. Since the take over these duties and until now, it was not understood that the acts or omissions of the authorities in public health policies may, in certain circumstances, engage their responsibility in terms of material appearance. The patient has the right to be respected as a human being, without any discrimination, regardless of the fact that his health problem aims physically or mental segment. The jurisprudence presented demonstrates that the ECHR judged a complaint brought by a nongovernmental organization, after the death of the direct victim. And that's because the victim did not have care givens, and the authorities concerned didn’t made the necessary efforts to take measures for the protection and proper care.
