Summary/Abstract: This paper aims to analyze the legal nature and the relationship between two important institutions in family law: The marriage and matrimonial agreement. In the context the proposed objective two questions asked: - Marriage and the matrimonial agreement they have the same legal nature? - Is there a determining relationship between the marriage and the matrimonial agreement? The study is done in the conditions which the national doctrine calls put under the sign question the contractual nature of marriage. Legal action is of interes theoretical and practica land trough the analysis of the matrimonial agreement, complex contract and with special affection.
