Impact of the New Building Act on the Czech Mining Law

Summary/Abstract: The paper focuses on the impact of the new Building Act (No. 283/2021 Coll.)on the valid Czech mining law, which is made up of several laws (especially the MiningAct, the Act on Mining Activities, Explosives and State Mining Administration, the Geological Works Act and the Act on mining waste management). The author defines the interrelationships of construction and mining law in the current legislation of the CzechRepublic and points out the differences compared to the previous legislation contained inAct No. 183/2006 Coll., on spatial planning and building regulations (Building Act). The author points out the changes in mining law brought about by the so-called AmendmentAct (No. 284/2021 Coll.). He focuses in particular on changes in the permitting of mining works and mining structures and on the newly introduced obligation of the organizationto examine the possibility of recultivation of the area disturbed by mining through restorationclose to nature. The pending changes to the new Building Act and the associated Act on the Unified Environmental Statement and their impact on Czech mining law are also not a side of his interest.
