Summary/Abstract: Article in Hungarian and Serbian The author of this article problematises the intriguing relationship between the minority rights and human rights. He treats especially the meanings of collective rights within the liberal tradition and raises the issue of underpinning and legitimating of the collective rights. In this article we can find an argumentation that demonstrates the failure of the legitimating practice based on the projected human essence. The author concludes that there is no opportunity to derive the minority rights connected to the communities with the references to the traditional structures of human rights. Th ere is clearly the need to declare the minority rights by international community as the human rights were declared long ago.
