Evidence obtained from an investigation through an undercover officer

Summary/Abstract: The subject of this article is the undercover investigation as a secret method of evidence in the criminal process and the results of its application. The nature of the undercover investigation, as well as the rules of the Criminal Procedure Code (CPC) relevant to its application, are subsequently considered. The results of the evidentiary materials collected through the use of special intelligence means have been analyzed. In conclusion, the decisions of the European Court of Human Rights related to the issue in the context of the right to a fair trial within the meaning of Art. 6 of the ECHR are studied.
