Summary/Abstract: The compliance assessment of Art. 145, Para. 1, Item 3 concerning the words ‘and actions’ and ‘and inspection’, as well as ‘or any other offence’ in Item 6 of the Bulgarian Judiciary Act can be carried out only if compared to Art. 127 of the Republic of Bulgaria’s Constitution. A starting point of this comparison is the content of the legal powers and its relation to the various constitutionally established methods through which the Public Prosecutor’s Office monitors compliance with the law. Based on the arguments provided, the conclusion has been drown that the relevant provisions do not contradict Art. 127, Para. 5 of the Constitution.
