Summary/Abstract: Participating in crime association is not a continuous crime. Its executive act is done by action – active behavior, which express perpetrator’s willingness to join a particular association. Crime is considered done once the perpetrator has become part of the association’s organizational structure. The statute of limitations for criminal prosecution starts from the moment the crime is completed. Local competent authority of pre-trial proceedings is the one on whose territory the crime was committed. Duration of participation has impact on choosing the type of punishment and its individualization.
