Summary/Abstract: Criminal prosecution is a highly responsible activity, the success rate of which is a criterion for the effective functioning of state power. The degree of prevention, control and overcoming of crime as a criminological and social phenomenon is a vivid example of the extent to which the rule of law has been built in our country. In this regard, the position of the state prosecution is of key importance, which in order to achieve its goals, it is necessary, in addition to being independent and objective, to be used legitimately to bring to criminal responsibility the persons who have committed crimes. All this is possible only with the cumulative manifestation of the legally established prerequisites, while at the same time there must be a tendency to avoid unnecessary repression. The presented situation is synchronized with the criminal law policy in the country, according to which, in addition to striving for the rule of law, the embodiment of justice is also manifested in the legalization of crimes and the corresponding punishments for them. All of this has a direct impact on the activities of both individual prosecutors and the prosecutor's office as a whole, since only in the presence of a unified, centralized and independent prosecutor's office can the latter be considered as a guarantor of the protection of the rights and interests guaranteed by law citizens and legal entities.
