SALE OF THE INHERITANCE

Summary/Abstract: Due to the complexity of contemporary socio-economic relations, in the civil juridical relations we encounter numerous situations in which the transmission of rights for a price set in money requires the regulation of aspects related to the specificity of these rights, which the legislator did by adopting special rules for the so-called sales varieties, which are complemented by the general rules on sales. One of these varieties is the sale of the inheritance, known under the former regulation as the "sale of inheritance rights". The provisions of the new Civil Code regarding the sale of inheritance regulate the form - ad validitatem and ad opposabilitatem, the guarantee owed by the seller, the extent of the seller's obligation of entrusting, liability for inheritance debts, as well as the common law status of these regulations regarding other forms of alienating the inheritance.
