LEGAL AMENDMENTS IN THE ARCHIVES FIELD. A NEED OF THE TIME

Summary/Abstract: As in any area of development of human society and the rule of law, having the most accurate framework of rules and laws is a necessity for a good management and governance. In this view, even in the archival field, the rules have been quite clear and they have long guided archivists towards a fairer archival policy. The Law on Archives is one of the main instruments that regulates the proper functioning of the archival network in the Republic of Albania. In this context, the General Directorate of Archives has deemed it reasonable to improve the legal framework for archives as Law no. 9154, dated 06.11.2003, “On archives”, is outdated and does not respond to several issues found in practice. The purpose of these amendments is to harmonize the law on archives with other laws and by-laws in the Republic of Albania, with which until now some of the articles are in conflict or duplicated; guaranteeing the principle of operability, clearly separating active archives and historical archives; including, through the creation of central archives in operation, the guaranteeing of the preservation of documentation produced by the private sector, in function or for public interest, regulation of issues on working with documents in the archives in operation and the profession of archivist, reorganization of the archival network of the Republic of Albania, the possibility of creating, only by law, of special state archives, etc.
