Considerations on the effectiveness of the current criminal protection of enterprise’s secrets

Summary/Abstract: The purpose of the article is to analyze and present an opinion on the economic role of information constituting enterprise secrets and analyze the specific and separate legal protection of such assets. It is emphasized that Poland has extensive regulations on this issue, included in the provisions aimed at combating unfair competition between entrepreneurs. Unauthorized possession, disclosure or use of another company’s secret is currently a separate act of unfair competition. Some of these acts are even criminalized as separate offences. This article also indicates that criminal protection against this type of behaviour cannot be effective in many situations, emphasizing the reasons for this assessment
