Summary/Abstract: In vitro fertilization (IVF) is the most advanced technique in medically assisted reproduction. For years, there have been numerous controversies in public discourse regarding the use of this method. Concerns are raised that a series of procedures accompanying in vitro fertilization may pose a threat to the existence of in vitro embryos. The aim of this paper is to draw attention to the issue of handling surplus embryos, cryopreservation and the use of preimplantation genetic diagnosis. It is undisputed that protecting embryos from embryo transfer also requires the interference of penal law. In Polish criminal law, the protection of in vitro embryos is carried out by selected penal provisions outlined in Chapter XII of the Infertility Treatment Act. This study analyzes these provisions and points out interpretational uncertainties that their application may raise.
