HOUSE ARREST AS A PREVENTIVE MEASURE

Summary/Abstract: In terms of preventive measures, the current Code of Criminal (Penal) Procedure presents a series of changes concerning the form and substance. While within the former legislation there were four preventive measures: detention, obligation not to leave the territory, obligation not to leave the country, and preventive arrest, Article 202 of the Code of Criminal (Penal) Procedure in force provides as preventive measures detention, judicial review, judicial review on bail - existing institutions in the past, as well - house arrest, and preventive arrest. Except for house arrest, the other four measures have similar regulations in the old provisions, with some obvious and necessary improvements.
