Summary/Abstract: Art. 314 of Bulgarian Labor Code stipulates that an employee that because of a sickness or a labor accident cannot work current job, but could without health risks do another job or the same job under appropriate accommodations, is to be accommodated by an order of health authorities accordingly. In the article the legal essence of this order for labor conditions’s accommodation is analyzed. The opinion is advanced that the act under art. 317 of Labor Code through which this order is made is not compulsory administrative measure within the meaning of art. 22 of Bulgarian Administrative Infraction and Penalties Act, but individual administrative act within the meaning of art. 21, s. 1 of Administrative Procedure Code. Thereupon conclusions are made concerning rules applicable for issuing and attacking this order for labor conditions’s accommodation.
