Summary/Abstract: The study presents the existent legislation on affirmative measures in Romania and the European Union. By exemplifying the relevant jurisprudence of the European Court of Human Rights (ECHR) and the Court of Justice of the European Union (CJEU) the different approaches of the two courts become evident. The Romanian cases presented in the study prove that the National Council for Combating Discrimination in Romania follows, more or less, the approach of the ECHR. Nonetheless a review of the regulations undertaken by the Police Academies and Police Schools of Romania, demonstrate that these institutions, in their recruitment policy, provide support for underrepresented categories.
