Summary/Abstract: In this article it is put in evidence the stand ofthe Moslem clergy towards SOlne problenls which had to do with the fUlnily and social position ofthe Moslem wonlan as vvere the custom ofthe betrothal ofthe girl in Ininority, making pronlise and exchanging tokens of betrothal, the covering ofthe Moslenl female with veil and yashmak worn by Mosleln WOlnen, the stand towards the laws ofthe Civil Code, etc. Since the year 1918 the Moslem clergy Illade its pronounciation on the custom ofbetrothal ofthe girl in nlinority, rnaking'promise and exchanging tokens of betrothal. l'his Inanner of betrothal was a characteristic ofthe nornlS ofthe customary law which was different from the nonns ofthe Islalnic religion ofthe betrothal according to which the girl shoud give her consent ahead the betrothal. That's why the High Council of Sheriat took a decision which prohibited the betrothal ofthe girl in I1linority without her desire. Such a betrothal, \vas considerate as illegitimate. There it was based the opposition of the girls towards such betrothals and it was accepted as quite moral their Inarriage with another nlan. By this decision distributed to the courts of sheriat it \vas requested that the Moslenl population should refer Inore to the Islamic nornlS for the betrothal and I1larriage ofthe girls than to country's customs.
