Summary/Abstract: Our study was prompted by changes in procurement enactment, changes with major impact in determining the legal nature of the contract. Public procurement has been our constant concern from a dual perspective, both theoretical and practical. The reason these approaches derive from the great importance this work has for society, for each local authority and especially public authorities, developing administrative units are decisively influenced by the volume, nature and structure of public procurement. In this context, the interest in this matter is justified by the unfortunate consequences that cause repeated changes in the procurement regulations in administrative practice and jurisprudence.
