Summary/Abstract: Straipsnyje nagrinėjama valstybės ir Bažnyčios pozicija dėl skirtingos būsimų sutuoktinių lyties. Valstybės ir Bažnyčios požiūriu, skirtinga sutuoktinių lytis – esminė sąlyga, kad sudaryta santuoka galiotų. The Church and the State conceptions of marriage and family institutions are near, but not the same, the conception of the State marriage law is more concentrated into realization of the marriage life, and the church marriage law – into marriage main points and more summarized goals. The biggest difference between the State and the church marriage law is that church doesn’t recognise the indissoluble of the marriage. In this point positions of the State and church are quite different. According to the Church understanding, marriage as a sacrament first of all is a gift of God’s grace. The spouses do not belong, however, to the ideal area, but live this ideal in the everyday life marked by human weakness. They are capable of developing received grace, but - because of their weakness - they can also destroy that grace. The state interprets the marriage as a contract of marriage, created at a representative of the civil authorities keeping within laws promulgated by the state; it may be examined in two aspects: as an act of a moment, that is, as a wedding (matrimonium in fieri) and as a constant mode of life, as an estate (matrimonium in facto).
