Summary/Abstract: During the nearly 78 years that have elapsed from the date of entry into force of the Criminal Code of 1936, rape has undergone significant changes and additions, original provisions which are no longer able to deal with current needs of society. In this paper we propose a comparative approach to the evolution of legislative regulation of criminal liability for the crime of rape, which led to align Romanian legislation to the European one.
