Summary/Abstract: The article attempts to clarify the provisions of the Article 168 (9) of the Law no. 1/2011, which establishes the obligation to post the doctoral dissertation on a website special created. Since the provision for this requirement is not very clear in protecting the copyright, in the article are presented models and examples of good practice. All come in to support the idea that the law is not providing a compulsory license. It is absolutely necessary the agreement of the author to reproduce and to communicate publicly the thesis. The agreement between the PhD candidate and the site administrator must provide a non-exclusive and limitedtime assignment of the copyright, in order to keep the interest of the publishers and respecting the Article 41(1) of the Law no. 8/1996.
