Summary/Abstract: The adoption of legal rules governing the situation of civil population during armed conflicts, was not an issue of concern for states, at least not from the very beginning of International Humanitarian Law. States were primarily preoccupied to regulate the means and warfare of war or the protection of those combatants who were wounded or captured during the hostilities. As a consequence, legal rules governing the situation of certain categories of civilian population, such as children, women and journalists were adopted only latter. If at the end of the Second World War 5% of the victims were civilians, contemporary armed conflicts resulted in a great number of civilian lives lost. For example, in the ex-Yugoslavia conflict, over 80% of the victims were women and children and during present days civil wars, this percent ranks even at 90%. All this statistic data are serious factors which indicate that the International Humanitarian Law should pay much more attention to the development and specialization of its legal norms. This article will focus on the legal protection, through International Humanitarian Law instruments, of women and children during armed conflicts.
