The procedure of filtering the appeals at the High Court of Cassation and Justice according to the New Civil Procedure Code

Summary/Abstract: Among the novelties brought by the New Civil Procedure Code regarding the existing regulation at the time of its entry into force, this article makes an analysis of the special procedure of filtering the appeals regulated in art. 493 NCPC. The special procedure of filtering the appeals is only used when the appeal is referred to the High Court of Cassation and Justice and is neither an orgininal institution of Romanian law, nor an absolute novelty in the Romanian civil procedural regulation, a procedure of verifying the admissibility in principle of the appeal being found recently, in the 2003-2004 legilslation when, as a rule, the judgement of the appeal by the supreme court was used.
