Summary/Abstract: The evolution of copyright in terms of its application comprises at least two stages: the first step regards the adoption of laws, namely the European Directives, treaties and international conventions, and the second stage refers to the implementation of the law by the courts and other authorities. If the first stage involves the materialisation of the right in law rules (national laws, directives, conventions, treaties etc.), the second stage generates the dematerialisation of the law norms and their transfor¬mation, for example through the genesis of judges, in jurisprudence, in those decisions of the courts that put in application the norms of law. The article comprises some of the most important case-laws of the European Court of Justice in the field of copyright and related right, regarding the right of reproduction, the resale right, communication to the public right and other rights and elements in the field.
