Summary/Abstract: The paper is devoted to disparities and controversies related to determining the scientific status of the tourist law within the legal system. In the publication an attempt is made at delineating the criteria of functioning of the tourist law as a relatively autonomous domain of science. The issue of determining the methodological criteria to isolate the new branch of law is, on the ground of theory of law, one of the most debatable. Making use of the output of the legal doctrine, the author essays to present arguments approving of isolating the tourist law as an independent domain of science, as well as those put forward by opponents of the investing this domain with the autonomous status. In order to sketch the essence of the problem area, a review of concepts and theories existing in the doctrine has been made. At the same time the discrepancy in the standpoints, at the attempt to define both the notion of the very tourism itself and that of the tourist law. Consequently, the aim of the work has been to discuss both the tourist law as an independent branch of law and the holistic ‘understanding’ of the tourist law as an interdisciplinary branch of knowledge, including its methodological consequences.
