Summary/Abstract: Community Law laid down general principles that constituted tha major part of the acquis to the Member States. Among the principles adopted by the European Court of Justice (ECJ in the following text) there are the principle of equity, that of proportionality, certainity and the principle according to qhich the Community legilation has primacy over national legislation. Our paper focuses on tha latest. Primacy aver national legislation means the relation between the national regulations and European legal provisions. It was interpreted by the ECJ on the grounds of European Treaties and it represents the Court’s creation. Mostly, it is designed to frame an effective application of European Community law.
