Summary/Abstract: According to the International Court of Justice of the United Nations, if states want to use legitimate force, the international law has to be respected, in particular the principles and rules of international humanitarian law. A democratic state, where human rights and fundamental freedoms are guaranteed, cannot ignore the urgent need for the same rights and freedoms to be strictly observed by the military, where armed forces are engaged in international military operations, especially in the current struggle against terrorism and cross-border organized crime. In general, democratic control over armed forces represents a guarantee that human rights and fundamental freedoms are respected, both within the armed forces and the actions of combatants during military actions.
