Summary/Abstract: In this study I am proposing both an analysis of the provisions of Directive 2001/23/CE regarding the harmonisation of the legislations of member state referring to maintaining the rights of the employees in the case of companies, units or enterprise parts’ transfers, which regulate the protecting measures stated in favor of the employees affected by the transfer, and of the European Union Court of Justice’s jurisprudence in the matter.
