Definition of the crime in the new Criminal Code

Summary/Abstract: The vision according to which the new criminal legislation was elaborated also required a new definition of the crime. The one contained in art. 17 of Criminal Code 1968 has often been criticized in the literature for including, among the key features, the social danger of the crime, but also because it did not allow a classification of causes that remove the criminal nature of the act, although some of them aimed the anti-judiciality and others the guilt, with negative implications regarding the application of criminal sanctions.
