Summary/Abstract: This paper analyses the problem of the EU non-contractual liability for the damages caused by the counter-terrorism measures – so called smart sanctions in the form of freezing the assets of the individuals allegedly associated with the terrorism and the approach of the Court of Justice to this sanctions. It deals with the actual case-law, concretely the judgement in the case T-341/07 Sison III.
