Summary/Abstract: The article which title is “The legal status of children who work” as a whole is apply to the youngest group of people who the law allows to carry out of specific categories commercial activities, under certain conditions. Object of interest is analysis of the legal definition of child in the context of its employee activity and also laws and obligations which is connection with this activity and which as a whole will be determine their legal status. In the process of engaging of children the important role is being note also a third person, i.e. labor inspector and legal guardians, which is also connection with a number of rights but also with obligations which must be fulfill. This issues, in which will be paid attention, must be corresponding with assumptions Polish labor law, however there should be considered this assumptions in combination resulting from the rule of law of family law and guardianship. The target is ensure due protection to this specific group of people, by what is so important to appoint a clear boundaries which will be favor to implementation this protection. In the text will be presented applications de lege ferenda correlate with contents of Directive EC 94/33 on the protection of young workers, which is prepared by Labour Law Codification Commission.
