Legal opinion on the legal obligations of local self government units towards real estate owners and their claims in connection with the adoption of the local development plan or its amendment

Summary/Abstract: Real estate owners, whose right to use the propertywas infringed or heavily restricted, are entitled to request: compensation, buyout ofthe real estate or access to a replaceable real estate. These claims shall be subject toa limitation period. In a situation where a development plan of a given plot of landpredicts a public road, the owner of that real estate is also entitled to compensation fora plot separated for the construction of the road which ex lege becomes a property oflocal self-government units. The claim is not subject to a limitation period.
