Summary/Abstract: The institution, as a state establishment, is the main subject of administrative law. Its organization and functioning aims at law creation, law enforcement and law administration. The legal capacity of the institution is demonstrated through its organs, in this respect, the achievement of institutional sustainability is dependent on administrative legal capacity. The present research discusses the essence and types of administrative legal capacity. It presents the essence of the institution as a subject of administrative law. The role of administrative legal capacity for institutional sustainability is outlined.
