Summary/Abstract: The article analyses certain aspects within the legal regulation of the counsel in criminal procedure. The debatable issue whether the counsel has the quality of a party to the court proceedings, and independent procedural rights, is discussed. Suggestions are proposed for improvement of the legislation in order to guarantee to a greater extent the defence of the victim, the legal person, which has sustained damages from the criminal offence, and the civil respondent.
