PARTICULARITIES REGARDING DONATION BETWEEN SPOUSES AND DONATION TO FUTURE SPOUSES

Summary/Abstract: In the present study we propose to analyze, from the practitioner's perspective, the donations between spouses, insisting both on the theoretical aspects but especially on the particular situations that can arise in the judicial practice in the hypothesis that the donated good was alienated by the donatar husband before the donation was revoked, as well as on the mechanism of revocation of donations between spouses, but not least on the form of the revocation act in the hypothesis of donation that involves immobile goods, when the land book provisions must be respected. Simulated donations, as well as donations made to future spouses were also object of analysis.
