Summary/Abstract: This article intends to briefly present the issues arising from the amendments to the definition of the civil servant in the new Criminal Code. It also presents the decisions of the Constitutional Court and of the High Court of Cassation and Justice, whereby the situation of certain categories of civil servants and their accurate positioning into the text of the law is achieved. The current regulation on civil servants has tried to solve the legal classification problems of different categories of persons. However, there is still room for discussions on liberal professions such as lawyers, notaries, bailiffs.
