Summary/Abstract: The failure to summon the aggrieved party in the case, respectively commune Drăguțești, the first court ruled an illegal decision subject to annulment according to the provisions of art. 421 item 2 letter b) of the new Criminal Procedure Code, since the case was trialled in the absence of one party which was illegally summoned.
