The Protection of Human and Minority Rights of Roma in International Legislation

Summary/Abstract: Roma are always and everywhere, in all historical periods, throughout the world and in our country, the most vulnerable and socially excluded minority community. According to the Roma community is expressed the greatest degree of discrimination and the ethnic distance. Roma minority is characterized by spatial ghettoisation, poor housing conditions, social segregation, extreme poverty and extremely high rates of illiteracy and unemployment. The aim of this paper is to show what and how much the protection of Roma individual and minority rights international documents provide in the framework of the UN, Council of Europe, OSCE and EU. Although the normative regulation at a relatively high level, remains the problem of its effective and consistent implementation in practice as well as question how countries implement commitments they have accepted. Although the protection of human and minority rights of Roma is regulated, directly or indirectly, in many international documents, the general standpoint is that it is primarily a European problem and that the stability and security of the whole region largely depends on its solutions. Furthermore, minority protection does not only understand prohibition of discrimination, but also the creation of conditions for promoting position and guaranteeing rights to members of the Roma national minority in maintaining their ethnic traits and national identity.
