Summary/Abstract: The article deals with the institution of omitted participant in proceedings decided by another authority and analyses in detail the various shortcomings of the legislation relating to his participation in the proceedings. Particular attention is paid to the action brought by omitted participant. In some cases it may not be clear whether and under what conditions is the omitted participant capable to fulfil the various conditions prescribed by law for the proceedings under the Part Five of the Civil Procedure Code.
