Simplified Forms Of Treatment In Misdemeanor Matters In Republic Of Srpska

Summary/Abstract: Misdemeanors are a special category of criminal offenses that violate public order, i.e. the regulations on economic and financial affairs established by law or other regulations, for which certain characteristics are determined and specific sanctions are prescribed. For this type of criminal offenses a series of sanctions is foreseen where monetary penalties need to be emphasized because the imposition and the execution of such penalties in misdemeanor proceedings bring the realization of significant funds in the appropriate budget. Therefore, in all modern countries in the world legislative bodies are trying to regulate misdemeanor proceedings to make them more purposeful, efficient and economical what again ultimately leads to a significant and rapid charging of the appropriate budget. An interesting form of simplified solving of misdemeanor offenses, introduced in the misdemeanor legislation of the Republic of Srpska, i.e. Bosnia and Herzegovina in 2006 by the adoption of the Law on Misdemeanors of the Republic of Srpska, i.e. relevant misdemeanor laws in Bosnia and Herzegovina, is the so-called misdemeanor warrant. Today, this is a special concept of starting and running a misdemeanor procedure, and therefore of the resolving of most misdemeanor cases, (which is also foreseen in the misdemeanor legislation of the Republic of Slovenia, the Republic of Croatia, and most recently, in the Law on Misdemeanors of the Republic of Montenegro). On the other hand, the statute is another form provides a simplified procedure in misdemeanor matters: it’s called. agreement on the penalty. In this paper I will be just words on these forms of treatment.
