Summary/Abstract: The article focuses on emerging issues in the case law about implementing the prohibition „reformatio in pejus“. The effect of the prohibition in appeal and cassation proceedings, as well as in the proceedings on the resumption of criminal cases, is discussed. Тhe decisions of the Courts of Appeal and of the Supreme Court of Cassation, which most often give rise to questions related to the application of this rule, are cited.
