Summary/Abstract: Fundamental rights, freedoms, and duties are not only a reality but also a condition for a democratic society.Fundamental rights, freedoms, and duties, with their many ramifications and theoretical and practicalimplications, are an important area in the concerns of each state. The constitutional principles applicableto the fundamental rights, freedoms, and duties of Romanian citizens are generally recognized mandatoryrules that have proven their reliability over time. Their institutionalization at the constitutional level providesthem with the most effective legal guarantee, as they benefit both from mechanisms guaranteeing thesupremacy of constitutional norms, as well as from legal mechanisms specific to the protection of subjectiverights. Regulated in the Constitution of Romania, these principles refer to universality, no retroactivity,equality, legal protection, free access to justice, restriction of rights or freedoms, and the presumption ofinnocence. The present paper will try to make a brief presentation of these constitutional principles, whichconstitute the fundamental source of the fundamental rights, freedoms, and duties of the Romanian citizens.
