Summary/Abstract: The unjustified extension of the in rem criminal prosecution phase and the admission of the essential probation during this phase, followed by the in personam formal criminal investigation, without informing the defendant of the main information regarding the evidence used during the prosecution, violates the conventional and constitutional principles of the right to a fair trial.
