On the New Hungarian Constitution

Summary/Abstract: The new Hungarian Constitution came into force on 1st January 2012. Ever since the drafting of the Constitution to this day, this highest legal act has been subject to highly unusual public criticism and general media attention, that no current constitution has been exposed to so far. On the other hand, expert legal analysis of the constitutional provisions that we are providing here draws a parallel to the “related” constitutions (namely, it refers to twenty seven former socialist countries); this analysis, as will be demonstrated, transfers the above-mentioned public criticism from the context of the legal profession and impartiality to the sphere of politics and current international relations. The criticism levelled at it is, namely, bizarre and legally immaterial. Nevertheless, our analysis points to numerous flaws in the text of the Constitution, which are primarily due to the superficial nature of the lay approach, inappropriate terminology, confusing systematisation and an occasional tendency to reduce the Constitution to the level of mere legislation. Furthermore, an inordinate number of provisions and their detailed specifications in relation to economic-financial relations and institutions lead to the conclusion that this Constitution will be short-lived and will have a limited application. Other negative assessments concerning the Constitution refer to the political activity of the complacent and intolerant political group that won the election in Hungary by a landslide.
