The approach to the environment in Polish and Italian law. Comparative aspects

Summary/Abstract: A legal definition of the environment is a very complex issue. The legislator must describe the phenomena occurring in nature by means of legal language. There are two options in this respect. The first one is a definition of the term “environment” incorporated by the legislator in a legal act. The other is the use of the term by the legislator without having an actual definition in place. Polish legal system has adopted the first solution, whereas in the system of Italian law the second one is applied. Analyzing these definitions, the consequences of each of the methods can be identified.
