Summary/Abstract: The current study is dedicated to a logical and legal analysis of general requirements, stipulated by Law No. 8/1996 on author rights and related rights, under which the work may be used by third parties without the consent of the copyright owner and of the circumstances under which work may be reproduced also without his consent. The study accredited the thesis of lack of „plagiarism” in those situations where the copyright owner has consented to the use of the work by others or „self-plagiarism” in the situation where the work is used by the author himself. Throughout the study are reported various legislative inconsistencies and stated proposals of lege ferenda, in order to remediate them.
