The project of Urbanization and Construction Code of September 30, 2016. Opportunities and risks

Summary/Abstract: The main object of the Urbanization and Construction Code is to order the investment processes in connection with shaping the principles of spatial order and normalization of Polish legal regulations. The analysis of the content of the code in comparison with existing laws, regulations and the results of current activities in area, indicates the need to correct it. The code should be adjusted to the structures and competences of public administration to define the professional responsibility of designers and officials, to pay more attention to certain aspects of spatial order. The purpose of this article is to show some of the anticipated effects of the entry into force of the code and to formulate proposals for its correction and additions (conclusions). The analysis of the way of acting in spatial planning shows the need to change the existing hierarchy of the planning system, to strengthen its economic foundation and to better coordinate the existing legislation.
