Considerations on the criteria for choosing different matrimonial regimes

Summary/Abstract: The regulation of a new legal framework regarding property issues between sposes marks an important step in what is called family relationships. We consider that the legislater interference in this field represents a real support for all married couples, both on peaceful times of their matrimony but also when they are crossing tough times, liable to injure their personal relationships. Therefore, before they take other drastic measures such as divorce due to property issues, sposes have the right to try to adjust their matrimonial regime, a right which is materialized by the fact that they have the legal right to sign a prenuptial agreement.By this study we wish to reveal wich are those decesive factors in choosing one matrimonial regime or another in order to govern the property relationships of sposes, but also which are the main caracteristics of all matrimonial regimes regulated by romanian legislation.
