The contest between the smuggling offense and the crime of bribery

Summary/Abstract: The present article examines the possibility of simultaneously retaining in the burden of the customs official, as regards a single offence, the perpetration of a multiple offence, bribery, combined with smuggling.Analyzing the recent practice of the National Anticorruption Directorate, we consider that, to the extent in which the main charge is that of bribery with the intent of not carrying out the customs control, one cannot simultaneously hold the charge of smuggling since the latter offence lacks the prerequisite of stealing and concealing assets during a customs control.
