Summary/Abstract: The probative value of the declarations of the undercover investigators, collaborators,witnesses of justice is related to the specific of the Italian penal process, accusatorial type. So, the probation will be administered in a contradictory manner through an Anglo-American technique, the cross-examination of the witnesses through the parties. According to this principle, the right to silence of the collaborator and the witness of justice is denied, being recognized right to silence only in case they have the status of accused in the same trial.
