Imperfections of contracting in public procurement

Summary/Abstract: Public Procurement Law imposes market imitation orders on the public procurement, and therefore the problem of the effectiveness of such a regulation appears when the parties to the public procurement contracts are entities with different logic. The purpose of this paper is to reflect on contracting in the public procurement system in the context of economic concepts of contracts, such as agency theory and transaction cost theory. It is clear from the considerations that the shortcomings of public procurement contracts are similar to those in the private sector.
